GAO Bid Protest Results Trending Favorably for Protesting Contractors

January 12, 2021

The Government Accountability Office (GAO) recently released its annual report to Congress, revealing that protestors received some form of relief in 51% of cases. This is the first time in several years that protestors crossed the 50% threshold, and represents a 7% increase over last year.

Also notable is the downward trend in the total number of protests filed, 2,137, a decrease of nearly 22% from the number of protest cases five years ago.

Overall, it appears that protestors are being more selective in filing protests, and as a result their level of obtaining relief is increasing.

Fox regularly handles federal contract bid protests. We represent both protestors and intervenors and we’d welcome the opportunity to work with you to evaluate if a bid protests may be appropriate for your company or if you seek counsel to defend an award against a protest.
