New FAQs on Families First Coronavirus Response Act

Important Notice – the U.S. Department of Labor has again updated its Families First Coronavirus Response Act (FFRCA) FAQs.

In addition to the FAQs, employers should read and become familiar with the DOL’s temporary regulations regarding the FFCRA. You can read our analysis of the temporary regulations here.

Please be mindful that FAQs, although setting forth the DOL’s current position on various issues, do not have the full force and effect of law and may be subject to challenge at a future date.  Specifically, courts may construe the FFCRA contrary to the DOL’s FAQs, particularly where, as in some of the current FAQs, the DOL’s interpretation appears to conflict with certain FFCRA provisions.

Employers should check the DOL website periodically for additional FAQ updates as well as any possible changes to previously posted FAQs.
