Risa represents owners, developers, contractors, design professionals, commercial landlords and other construction and real estate sector clients in a broad range of commercial litigation in state and federal trial courts, in arbitral forums, and on appeal. An integral member of the firm’s Denver litigation team, she has a particular focus on the thriving Crested Butte real estate market, which she calls home.

Her experience includes disputes involving:

  • Construction and design defects
  • Recovery and subrogation
  • Constructive changes, acceleration and delay
  • Breach of contract and indemnity
  • Commercial litigation
  • Title insurance claims
  • Easement and property line boundaries
  • Landlord-tenant issues

In addition to helping clients efficiently resolve their disputes, both at trial and the negotiating table, Risa has significant appellate experience, including representing a national homebuilder before the Colorado Supreme Court in a precedent-setting win for real estate developers.

Risa was also part of the appellate team that litigated Broomfield Senior Living Owner, LLC v. R.G. Brinkmann Company, 2017 COA 31, 413 P.3d 219 reh'g denied (Apr. 20, 2017), cert. denied, No. 17SC351, 2017 WL 3868161 (Colo. Sept. 5, 2017). The Court of Appeals’ opinion in Broomfield assessed the term “residential property owner” in Colorado’s Homeowner Protection Act of 2007 as a matter of first impression and applied it in the context of a construction defect action involving a residential senior living community.

Risa has served as appellate counsel in nonpublished cases as well, authoring briefs in the Colorado Supreme Court and Colorado Court of Appeals on behalf of owners, developers and other real estate sector clients.
