Biography

Scott is Co-Chair of the firm's Retail Industry Practice Group and a seasoned closer who assists clients with strategic business solutions. He has nearly three decades of experience guiding property leasing and development deals for national and regional retailers and negotiating commercial leases of office, warehouse and industrial space.

He serves a range of institutional and private sector clients ― as sellers, purchasers and developers ― in all phases of real estate transactions and negotiations and provides strategic insight on zoning, land use, title, insurance coverage and financing issues. Scott has a particularly keen understanding of the retail property development life cycle, from construction to store launch and beyond. His practice also covers all aspects of commercial leasing, including construction-related disputes, permits, variances and diverse development issues.

An industry leader, Scott was among the first attorneys to develop the practice of buying leases from bankrupt companies and has been a trailblazer in handling retail leasing deals on military bases. His clients include Fortune 500 retailers as well as smaller national and regional chains, New York City commercial real estate developers, insurance defense third-party administrators and emerging companies.

He also leverages his real estate knowledge to resolve complex leasing disputes and advise on land use efforts, including obtaining building and sign permits and advancing variance applications. Scott's negotiation and dispute resolution experience extends to contractual, licensing, construction, business and employment issues, and he has overseen premises defense insurance litigation as well as general bankruptcy matters for debtors-in-possession.

Scott's nuanced counsel is informed by years of representing a wide range of parties to transactions as well as commercial banks, landlords and retailers in commercial and real estate litigation during the first half of his career. In addition to guiding the purchase of bankrupt company assets, he has participated in several complex and high profile bankruptcy matters.

Scott is a former president of a condominium association in the Catskills, and is an avid skier and golfer. He is a long-time member of the International Council of Shopping Centers and serves on the editorial board for its Shopping Center Law & Strategy publication.
