Fox Rothschild Secures Trademark Victory, Establishing MEDDPICC as a Generic Term

Fox Rothschild attorneys Christopher D. Olszyk, Jr., Cali R. Spota and Ryan N. Miller secured a decisive trademark victory in federal court when a judge ruled that MEDDPICC — one of the most widely used sales qualification methodologies in the B2B industry — is a generic term incapable of protection as a trademark.

The ruling is a victory for Fox’s client, MEDDICC LTD, a U.K.-based firm that offers online sales training services and materials about MEDDPICC. The company said it was forced to file suit after a competitor had repeatedly accused it of trademark violations relating to the use of the MEDDPICC term.

The April 21, 2026, decision by Chief U.S. District Judge Wendy Beetlestone granted the Fox team's motion seeking a declaration of noninfringement and cancellation of the defendant’s trademark.

Chief Judge Beetlestone found that the relevant consuming public — sales professionals — primarily understands MEDDPICC to identify a sales qualification methodology, not a single source of training services.

The court found that MEDDPICC has been adopted by the sales teams of many large software and technology companies worldwide, and that proficiency in the methodology is a recognized and expected skill reflected in job postings across the industry.

The court ordered the Director of the U.S. Patent and Trademark Office to cancel Registration No. 6,489,058, held by Darius Lahoutifard of 01 Consulting LLC, doing business as MEDDIC Academy.

Christopher D. Olszyk, Jr., a partner in Fox Rothschild's Intellectual Property Department, said "MEDDPICC is a term that belongs to the entire sales community, and the court's decision confirms that."
