Practitioners are well aware of the benefits of trusts in wealth planning for ultra-high net worth (UHNW) clients; in the context of cross-border planning, a trust may be the ideal vehicle. However, given the variety of trusts, choosing the proper one can be challenging, and the relevant terms (to comply with cross-border requirements) are key to the success of the strategy. This session will review the main types of trusts in Canada and the United States (revocable and irrevocable trusts, grantor and non-grantor trusts, family trusts, and testamentary trusts) and discuss the tips and traps of using different types of trusts in the cross-border context.
