Fox Rothschild Uncorks International Trade Win for Wine Bottle Producer
A Fox Rothschild International Trade team prevailed before the International Trade Commission on behalf of our client Encore Glass Inc., the third-largest wine bottle supplier in North America, in an investigation concerning the importation of glass wine bottles from China and Mexico.
The Commission launched its investigation in December 2023 in response to complaints from a coalition of U.S. glass bottle producers, claiming that imports from China, Chile, and Mexico were injuring the domestic industry.
Lizbeth R. Levinson, Brittney R. Powell and Alexander D. Keyser argued the case before the United States International Trade Commission, which determined unanimously that imports of glass wine bottles from China and Mexico did not injure the domestic industry in the United States.
The Commission’s determination means that our client will not face any antidumping or countervailing duties for its shipments of glass wine bottles from Mexico and China.
More importantly, the Commission’s favorable ruling allows Encore Glass to continue serving its boutique winery customers with the same custom, high-quality bottles that are not offered by domestic bottle manufacturers.
