Following years of states competing to attract data center investment through state and local tax incentives, the landscape is shifting dramatically in many parts of the U.S. This panel will provide an update on the most significant recent developments in Virginia, Texas, and Washington State, including Virginia’s new electricity consumption tax, the Texas governor’s call for the repeal of existing data center exemptions, and Washington’s retroactive elimination of exemptions for existing certificate holders. Panelists will also survey broader national trends—from moratoriums, sunset legislation, heightened compliance scrutiny, and even some states’ renewed efforts to attract data centers. The discussion will include practical considerations for taxpayers managing risk in this environment.
