Panelists will explore litigation funding in ADR, including ethical and legal implications of the use of third-party litigation funding in ADR. Issues to be discussed will include what happens when a disputant’s goals and strategy diverge from the goals and strategies of its third-party funder and whether information that is otherwise confidential or privileged loses its status when shared by a disputant with its third-party funder. Panelists also will share perspectives on whether third-party litigation funding should be regulated, and if so, what regulations or changes should be implemented.
