Whatever the type of valuation dispute, an appraiser can serve in various roles depending on the context. This session will focus on the roles of the appraiser as a testifying expert and as support for resolving disputes, such as in mediation. Serving as a testifying expert requires special care to impress the court or arbitrator with objective analysis, not advocacy. This session will discuss several cases where courts discussed the line between objectivity and advocacy in appraisal testimony and will provide specific examples from the cases. It will also discuss alternative dispute resolution, including how an appraiser can support a client in mediation. This panel will provide practical advice from extensive legal experience as litigators, and for Judge Ramseyer, her years as a judge in King County Superior Court and as a mediator and arbitrator at JAMS. Attendees will benefit from learning with real-life examples in which courts have found that appraisal experts crossed the line into advocacy in testimony, how to implement practical tips to ensure objective and credible testimony, and develop skills for supporting your clients in constructive negotiation between parties in mediation.
