This presentation will cover complex asset sales by Trustees in Chapter 7 and Chapter 11-Sub V, including the liquidation of tangible personal property, turn-key business assets, intellectual property, jointly-owned real estate, multi-family investment real estate, and commercial and industrial real estate.  The discussion will include establishing the method and terms of the sale, utilizing a stalking horse bidder, break-up fees, use of bidding deposits and other bidder qualification provisions, value-maximizing auction mechanics, default remedies, report of sale, and distribution of proceeds.  Trustees will also learn about when and how to employ appraisers, valuation consultants, real estate brokers, auctioneers, market-makers, and other professionals to effect the sale and/or maximize the price obtained.
