Update on the EV Disruption to New Motor Vehicle Distribution

Distribution of vehicles in the United States has centered on independent dealerships selling to consumers and servicing vehicles after the sale. This distribution model was created by state dealership laws that largely prohibit manufacturers from selling directly to consumers.

Electric vehicles are relatively new entrants to the industry. In making their entrance, they have sought to sidestep the laws that prohibit direct sales. Some, most notably Tesla, have been successful. This change to the distribution of new motor vehicle will throw a wrench in the machine, creating new avenues for lawyers to litigate the current vehicle distribution laws and their interactions with Franchisors and Franchisees.
