The recently issued FTC Proposed Rule banning non-compete covenants around the country creates uncertainty across industries, including health care. As the industry battles a general shortage of physicians and other professional staff, non-compete covenants have been critical to retention, as well as protection of practices. This presentation will discuss key provisions of the Proposed Rule, what the fallout could be if it is adopted, and what alternatives are available for privately-owned practices through provisions in employment agreements.
