As a result of U.S.- China tensions and the trade war, Chinese companies are relocating U.S. operations, and some have targeted LatAm countries. Cultural differences, unfamiliar U.S. requirements and operational and legal impediments often result in unanticipated challenges for these entities. Friction between directors and executives of the subsidiary and parent company frequently raise fiduciary concerns.
Data transfer restrictions in “unfriendly” countries create hurdles and delays. Compliance employment termination laws can be more expensive and difficult than originally anticipated. The panel of attorneys with experience in the US, Asia-Pacific and Latam will share tools and solutions of how to advise a parent company client to manage potential risks, cultural differences and legal issues.
