Interested in serving as an expert witness? Already experienced as an expert witness but keen to hone your skills? Serving as a testifying expert is one of the most satisfying—and most challenging—ways to engage in appraisals. Appraisal evidence is critical to winning valuation disputes. The demands on testifying experts vary widely depending on the case and forum. The presenters of this session have experience in different types of (1) valuation disputes, from property tax appeals to business disagreements; and (2) proceedings, including informal and formal administrative hearings, arbitrations, depositions, and trial. The session will discuss how litigation can affect everything from your engagement letter to considerations in data collection, not to mention subpoenas for testifying experts’ appraisal workfiles under Washington law—what should and should not be included in responding. The presenters will provide a perspective as litigators engaging with appraisers as part of a litigation team and will discuss what to expect from counsel and client and how to persuasively defend your appraisal or appraisal review while on the hot seat.

Objectives:

  • Distinguish requirements of testifying experts in different types of legal proceedings in Washington
  • Assess what expectations are reasonable for counsel, client, and appraiser as part of a litigation team
