Fox Rothschild Team Clears Florida City in Suit Over Felled Stop Sign
A Florida appellate court has agreed with a Fox litigation team, ruling that the City of North Miami Beach cannot be held liable for a car accident allegedly caused by a fallen stop sign since the evidence showed it was knocked down by Hurricane Irma.
The decision by the Third District Court of Appeal is a win for attorneys John Herin, Victor Sanabria and Maja Veselinovic. The suit alleged that the plaintiff, a passenger, was injured in a collision at an intersection and that the City and County had breached their duty of care by failing to properly maintain stop signs.
In the appeal, the Fox team successfully argued that the City of North Miami Beach did not owe a duty of care because Miami-Dade County had assumed responsibility to maintain the road and traffic signals in question, and that the City could not be held liable for a danger it did not create or was aware of. The accident occurred in September 2017, shortly after Hurricane Irma passed through the area.
