Kathy Kimmel Featured on Minnesota Lawyer’s Business Litigation Power List

Fox Rothschild congratulates Kathy Kimmel, who was named to the 2025 Power List: Business Litigation by Minnesota Lawyer for the fourth consecutive year.

The annual guide highlights attorneys “whose mere presence on a case signifies the stakes, who have influenced the direction of the law, whose leadership in the community is pervasive and whose respect within the bar is undeniable.”

In a Q&A feature, Kimmel told Minnesota Lawyer the biggest challenge in business litigation is cost. “The high costs require attorneys and clients to be thoughtful and strategic, open to re-evaluating decisions, and creative in exploring appropriate use of technology,” she said. Kimmel also noted that exploring settlement at various inflection points in a dispute is often misunderstood as a sign of weakness. “Discussions with opposing counsel, even if not successful in resolving the dispute, can help focus the issues that need resolution.”

One of Kimmel’s recent notable business litigation disputes involved a multi-year arbitration involving claims of defamation by implication. The case required complex legal analysis of constitutional and common law principles, which exposed an inconsistency among courts on who can assert such claims. She noted that “the matter involved compelling public policy considerations, strong views held by persons involved in the matter, and zealous advocacy on behalf of all the parties.”
