Biography

Mary Jean is an experienced commercial and intellectual property litigator. She has represented clients in a diverse range of matters in federal courts, cancellation proceedings before the Trademark Trial and Appeal Board, and arbitrations before the American Arbitration Association (AAA) and JAMS.

With a focus on intellectual property matters, Mary Jean advises clients on disputes involving patent, trademark and copyright infringement, unfair competition, counterfeiting and rights of publicity violations. Her patent litigation matters cover a range of technologies, from telecommunications and blockchain software to genetic therapies.

Mary Jean's diverse litigation background provides a broad perspective on dispute resolution. In addition to her intellectual property work, she has experience resolving real estate disputes and handling white-collar investigations.

Before Fox Rothschild

Prior to joining Fox Rothschild, Mary Jean worked for an international law firm. She also previously completed a judicial clerkship in the U.S. District Court for the District of New Jersey.

As an undergraduate, Mary Jean double-majored in Economics and Political Science.

Beyond Fox Rothschild

Mary Jean was selected to the 2022 Class of Pathfinders for the Leadership Council on Legal Diversity (LCLD), which consists of individuals who are committed to creating a more diverse and inclusive legal profession.

She is actively involved in pro bono representation of a death row inmate in Alabama seeking post-conviction relief. 

Representative Matters*

  • Represent biopharmaceutical startup company in federal court, arbitration, and before the Patent Trial and Appeal Board (PTAB), and asserting patent infringement, unfair competition, and antitrust violations.
  • Represent inventors in patent infringement and misappropriation of trade secret actions related to ionization technologies for mass spectrometry.
  • Defended and obtained summary judgment on behalf of multinational media and entertainment client in a copyright infringement action.
  • Part of team that represented magazine publisher in trademark and false advertising action against musical artists, arising from the unauthorized use of trademarks to promote their work.
  • Resolved arbitration on behalf of celebrity client asserting rights of publicity and trademarks.
  • Represented creator and developer of international mapping technology in contractual dispute over its light detection and ranging (Lidar) data and obtained favorable resolution in state court action against a former licensee.
  • Assisted special committee of the board of directors with an internal investigation concerning the alleged misuse of company assets for personal expenses, which resulted in removing the chairman and replacing the company’s CFO.
  • Intervened in pending state court litigation on behalf of purchasers of luxury Manhattan real estate to remove encumbrance filed by foreign bank, and obtained full release of the bank’s claims.
