Natural resources are defined expansively to include “land, fish, wildlife, biota, air, water, ground water, drinking water supplies, and other such resources.” Pursuit of Natural Resource Damage (NRD) claims by federal and state governments has notably increased in recent years especially in Colorado and New Jersey and present the potential for significant liabilities and opportunities under multiple federal and state laws. How will the PAGA promulgate prosecution and defense of PRPs?
