Intellectual Property Litigator Luke Toft Rejoins Fox Rothschild in Minneapolis
Fox Rothschild is pleased to welcome Luke Toft back to our Minneapolis office as a partner in the Intellectual Property Department.
“We are thrilled Luke has returned to Fox,” said Andrew S. Hansen, Managing Partner of the firm’s Minneapolis office. “His most recent in-house experience, paired with his ability to guide clients through post-grant proceedings and IP litigation matters, is a benefit to our clients.”
A registered patent attorney with the U.S. Patent and Trademark Office, Toft chairs the firm’s Post-Grant Proceeding Practice. He works with clients in a broad range of technologies, including 3D printing, adjustable air beds, medical devices, gene therapy treatments, construction, software and user interface advancements, refrigeration, firearms and food compositions, among others to manage their national and international patent and trademark portfolios, identify and extract new IP, and develop competitive IP strategies.
Toft has experience in each phase of litigation from pre-suit investigations through trial and appeal. He handles a wide range of complex matters, including patent, trademark, trade secret, copyright and other business-related disputes. He has successfully represented clients in state and federal court, in front of the Court of Appeals for the Federal Circuit and the 8th Circuit and in front of the International Trade Commission. He’s also effectively challenged patents and defended the validity of his clients’ patents in post-grant proceedings, serving as counsel in dozens of inter partes review proceedings before the USPTO and effectively using ex parte reexaminations to challenge the validity of patents asserted against his clients.
Toft earned his J.D., cum laude, from the University of St. Thomas School of Law and his B.A. from Concordia College.
Prior to joining Fox, Toft was director of intellectual property at Sleep Number Corporation. He was previously elevated to partner at Fox Rothschild in 2021.
