Biography

With more than 30 years of experience as a litigator, David helps clients resolve a full range of complex commercial, securities and commodities disputes.

He regularly represents clients ranging from Fortune 500 companies to broker-dealers, registered investment advisers (RIAs) and individuals who are involved in civil, criminal and regulatory investigations and litigation. He also represents these clients in contractual and transitional matters and provides counsel to help mitigate future legal action.

David has extensive experience representing white collar professionals. He protects clients' interests in SEC, FINRA (formerly the NASD and NYSE), NFA and CFP investigations and enforcement proceedings. He litigates on his clients' behalf in federal and state courts as well as in arbitration and has more than 100 arbitration awards and multiple published decisions. He has handled cases ranging from corporate raids, RICO, fraud and numerous other matters.

During his career, David has litigated several cases against clients that have been the subject of major motion pictures. He filed and settled multiple cases against Jordan Belfort, the self-proclaimed "Wolf of Wall Street," which settled for in the aggregate millions of dollars. He filed a civil action against Marion “Suge” Knight, former owner of Death Row Records (depicted in the Academy Award-nominated film, "Straight Outta Compton") and was one of the three attorneys who filed a federal class action against Fairfield Greenwich, the largest Bernard L. Madoff Invest Securities “feeder fund”, which settled for an amount in excess of $250 million.

David also represents hundreds of financial professionals and provides them with legal advice to help them maintain protocol compliance, transition their practice and resolve non-solicitation/noncompete issues. He is familiar with and speaks on the traditional, independent, RIA and bank brokerage models.

David was formerly an NFLPA-certified contract adviser and represents many active and retired professional athletes, including the PFWA Defensive Player of the year, the FedEx Ground Player of the Year, multiple current NFL Pro Bowl players, several recent top 10 overall selections in the NFL Draft, as well as three players selected in the top five of the NBA Draft. He also represents a Hall of Fame NBA player and now coach. In addition, he represents many high-level amateur athletes and their families in matters, including NIL (name, image and likeness), contract negotiation and due diligence.

Before Fox Rothschild

Prior to joining Fox Rothschild, David was a partner and litigation and regulatory enforcement practice chair at a commercial law firm. He previously practiced at a boutique firm and at a firm focused on white collar criminal defense. David also spent several years as General Counsel for BlueStone Capital, a broker-dealer.
