This presentation will provide an overview of discovery practice as encountered in trust and estate litigation. Topics will include attitudes toward discovery and discovery disputes in probate court, how to analyze issues, develop a discovery plan, propound and respond to discovery diligently and effectively, make use of alternatives to formal discovery in trust and estate litigation, handle common types of lay and expert witnesses, and how to use discovery to achieve good results for your client at mediation or trial of trust and estate disputes.
