Biography
A seasoned attorney with more than two decades of public and private sector experience, Fruqan focuses his practice on cannabis law, litigation and regulatory compliance.
Clients in the legal cannabis industry rely on Fruqan, and his detailed understanding of regulatory law, to guide them through all steps of the licensing and compliance process. His advocacy is informed by a strong knowledge of the state's economy and regulatory framework acquired while working in government, where he served as General Counsel for the New Jersey State Senate Majority Office and Assistant Counsel to former New Jersey Gov. John Corzine. Fruqan played a pivotal role in helping to write the 2021 state law legalizing recreational use of cannabis in the Garden State – the New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act.
In his commercial litigation practice, Fruqan is tenacious, pragmatic and unflappable. He represents clients in state and federal court, at the trial and appellate levels, working with them to achieve efficient solutions that advance their business goals, whether at trial, in arbitration or at the negotiating table.
Representative Matters
Fruqan has significant state and federal appellate experience that includes arguing a case of first impression before the 3rd Circuit Court of Appeals and a seminal case before the New Jersey Supreme Court addressing the constitutionality of a state statute. Both cases yielded oft-cited published opinions.*
- State v. Crawley, 187 N.J. 440 (2006): Developed, briefed and presented the New Jersey Supreme Court with an issue not previously conceived, challenging the constitutionality of New Jersey’s obstruction of the administration of law statute. Argued that a statute may not make it illegal for an individual to run from police officers when the officers lacked the reasonable suspicion necessary to compel a stop under Terry v. Ohio. . The case ended in a 5-2 decision against Mr. Crawley, it received much attention and is oft-cited and discussed in criminal procedure and fourth amendment presentations. It has been cited nearly 70 times in subsequent cases and commentary.
- United States v. Rowlands, 451 F. 3d 173 (3d Cir. 2006): Briefed and argued this case of first impression before the 3rd Circuit Court of Appeals, later filing a related petition with the U.S. Supreme Court. Converted the issue to a law review article, titled Forgive Us Our Trespasses: The Need for Federal Expungement Legislation. This case yielded an oft-cited published opinion.

Before Fox Rothschild
Prior to joining Fox Rothschild, Fruqan was of counsel and Chair of the Cannabis Practice Group in the Morristown office of a regional law firm. He is a former General Counsel to the New Jersey State Senate Majority Office and Assistant Counsel to former New Jersey Governor Jon S. Corzine, and has practiced as an associate and partner in New Jersey law firms. Fruqan was also an adjunct professor for several years at Seton Hall University School of Law.
After graduating law school, he was a law clerk to the Honorable Anne E. Thompson, Chief Judge of the U.S. District Court for the District of New Jersey and then to the Honorable Theodore McKee of the 3rd Circuit Court of Appeals.
Beyond Fox Rothschild
Fruqan is a member of the Board of Directors of the Corporation for New Jersey Local Media, a media conglomerate created to preserve and strengthen community journalism and that owns numerous local newspapers in the North Jersey area. He is also a former president of the Garden State Bar Association, New Jersey's African-American Bar Association.
