The Biden Administration’s DOJ, DOL, FTC and Treasury have joined forces to focus on employer conduct that restricts employee mobility, including non-compete clauses, no-poach agreements, and other types of restrictive covenants. At the same time, the existing patchwork of inconsistent state laws means that federal action in this area could have a huge impact. Panelists will discuss the evolution of both agency action and private litigation (antitrust and employment) with a focus on recent trends and best practices that employers use to protect confidential and/or proprietary information while not running afoul of laws protecting employee mobility.
