Representative Matters

  • Represented a global private investment firm with investments in health care technology in its response to a HIPAA breach involving its health care provider electronic records and billing software products. Fox represented the company in provider and patient class action claims, counseled them on how to comply with several new state privacy laws, and responded to major Health and Human Services (HHS) Office of Civil Rights Data requests/inquiries.
  • Defended a U.S. hospitality and resort company in federal class action proceedings for alleged violations of Fair and Accurate Credit Transactions Act (FACTA). Defeated class certification.
  • Defending one of the largest real estate brokerages in the country in punitive class action proceedings related to alleged ransomware attack. Pending.
