Biography

Jason advises clients on U.S. and international trademark and copyright strategy, clearance, protection, enforcement and transactions. His clients include leading companies in the film, television, music, apparel, restaurant, retail and technology fields. He has broad experience in developing multijurisdictional trademark and copyright registration, enforcement and litigation strategies.

He has written and spoken extensively on trademark issues impacting the entertainment field, the interplay between IP and generative artificial intelligence, and global IP legal systems.

He has broad experience in developing multijurisdictional trademark and copyright registration, enforcement and litigation strategies.

He has written and spoken extensively on trademark issues impacting the entertainment field, the interplay between IP and generative artificial intelligence, and global IP legal systems.

Representative Matters

  • Developed and oversaw multijurisdictional trademark litigation strategy for a major U.S. film financing company against a European film production company, culminating in litigation wins at the trial court and appeal court level in Germany, at the Supreme Court in Spain and trial court in the Netherlands.
  • Performed a 9-month secondment in-house at a major film and television studio advising on all aspects of trademark, copyright, title and production clearance, registration and disputes.
  • Represented a leading hospitality company in the successful settlement of a trademark dispute with British government agency administering real property owned by the Crown.
  • Counseled a multinational corporate client on international trademark issues in the environmental credit industry.
  • Advised a famous recording artist on trademark rights associated with development of high-definition audio player.
  • Provided international and domestic trademark portfolio management, and trademark counseling for a successful, Grammy-Award-winning music group.
  • Defeated a Summary Judgment defending a famous client from cancellation on genericness grounds for leading technology company.
  • Represented a leading technology company in a celebrity trademark and right of publicity licensing in connection with the multibillion-dollar acquisition of audio hardware and streaming music service.
  • In an ex parte appeal to the USPTO’s Trademark Trial and Appeal Board, overcame a refusal to register on descriptiveness grounds in connection with the brand name of an online game and information service.
  • Working closely with local counsel, successfully defended global financial services client in four concurrent administrative proceedings (two CTM oppositions and two CTM cancellation actions) by a single petitioner with strategic use of demands for proof of use.
  • Successfully negotiated a favorable settlement of a global trademark dispute for a music industry client involving mutual consents to registration and withdrawal of two trademark oppositions and a cancellation action.

Before Fox Rothschild

Jason joined us from a global general practice law firm. Earlier in his career, he was an attorney at a copyright and trademark boutique firm and was an Adjunct Professor of Advanced Trademark Law at Yeshiva University Benjamin N. Cardozo School of Law. Jason has an undergraduate degree in music production and was a professional recording engineer working on numerous major label releases, including Grammy award-winning and Gold and Platinum Certified Records.
