Biography

Keeley represents companies doing business with the government in a full range of government contracting matters, from bid protests and compliance with the Federal Acquisition Regulation to government investigations, claims and False Claims Act (FCA) litigation.

She is an experienced litigator and practices before the Court of Federal Claims (COFC), federal district courts, the Armed Services Board of Contract Appeals (ASBCA) and the Government Accountability Office (GAO).

In addition, Keeley monitors changing procurement regulations and trends in FCA prosecutions to provide forward-looking advice on risk mitigation and compliance programs and training.

Construction

Federal and state government contractors rely on Keeley to protect their interests in all stages of the dispute resolution process, from filing requests for equitable judgment, through mediation and, if necessary, at trial. She has experience working with damages experts to analyze cost overruns and delays as well as geotechnical experts on site conditions in relation to Federal Acquisition Regulation requirements.

Keeley advises health care clients on the unique challenges of selling to the federal government. She helps pharmaceutical companies and medical device manufacturers navigate the sometimes complex procurement process and resulting contracts with the Department of Veterans Affairs (VA), the Defense Health Agency (DHA) and the Centers for Medicare & Medicaid Services. She understands that government contracts are often only a small piece of her clients’ portfolios and helps them tailor compliance programs accordingly.

  • Led an internal investigation and crafted presentations, advocacy letters and document productions in response to a federal subpoena to a dental practice, then negotiated favorable settlements with the government and relator.
  • Obtained a declination by the Department of Justice in an investigation of FCA claims based on a government contractor client’s cost accounting practices
  • Defended a software manufacturer in a qui tam FCA litigation involving a GSA Schedule contract, culminating in a four-week bench trial before the D.C. District Court.
  • Defended a reseller of personal protective equipment sold to the government that was among 40+ defendants in a qui tam FCA case, resulting in voluntary dismissal following a motion to dismiss.
  • Represented an Alaska Native Corporation in a pass-through claim to the Air Force for increased pension costs.
  • Settled a constructive changes claim against GSA by an IT services provider through COFC-sponsored mediation.
  • Represented a small business prime contractor terminated for default for failing to complete two potable water wells on an Air Force base due to differing site conditions, culminating in a four-day hearing before the ASBCA and ultimate settlement with the Air Force.
  • Represented a prime contractor in an AAA arbitration against a subcontractor under USAID construction contract, including a five-day arbitration.

Before Fox Rothschild

Keeley joined us from a global law firm where she was co-chair of the Women Lawyers Group in the DC office.

Before law school, Keeley worked in Hiroshima, Japan, teaching English to Japanese high school students for two years. She continues to study Japanese language, culture and cooking.
