Biography
A highly experienced New Jersey environmental attorney, Ken practices primarily in the areas of:
- complex environmental, commercial, and toxic tort litigation
- environmental aspects of real estate and commercial transactions
Ken’s transactional experience includes:
- dealing with New Jersey’s Industrial Site Recovery Act (ISRA), formerly the Environmental Cleanup Responsibility Act (ECRA), since the statute’s inception
- assisting clients in obtaining the benefits of New Jersey’s brownfields legislation, including representation of a seller in one of the first substantial transactions under that law
Ken’s litigation experience encompasses matters in state and federal courts in New Jersey and beyond. His counsel in complex, multi-party environmental suits includes service as:
- third-party defendant generator liaison counsel in U.S. v. Kramer
- common counsel for the defendants in Transtech v. A&Z Septic Clean
- third-party defendant liaison counsel in Pennsauken Solid Waste Management Authority, et al. v. State of New Jersey, et al
- liaison counsel for the plaintiffs in Cabot Corporation, et al. v. Drew Metalex Corporation, et al.
Ken's leadership positions within the firm include:
- Former chair of the firm’s New Jersey Litigation Department
- Former co-chair the firm's Environmental Law Group
Beyond Fox Rothschild
Ken was elected a Fellow of the American College of Environmental Lawyers (ACOEL) in 2012. Members are dedicated to maintaining and improving the ethical practice of environmental law; the administration of justice; and the development of environmental law at both the state and federal level.
Ken is the former chair of the American Bar Association's Superfund and Natural Resources Damages Litigation Committee of SEER. He is also the former chair of the NJ Bar Association's Environmental Law Section.
