Biography
Nick’s practice is concentrated on federal government contracts with a strong emphasis on procurement disputes and claim resolution.
He provides legal advice to clients with respect to a broad range of matters, including:
- Bid protests and debriefing strategies
- Contract Disputes Act claims prosecution
- Federal ethics and compliance, including contractor Code of Business Ethics and Conduct training
- Internal investigations and False Claims Act prosecution and defense
- Small Business Administration Set-Aside Program guidance and size protests
Nick also represents contractors and the owners of regional and national construction companies in a full range of private and public projects, including contract negotiations and litigation.
As a seasoned litigator, Nick has successfully represented clients in disputes across the country, including the following representative and ongoing matters:*
- Successfully represented a federal contractor in a breach of contract dispute in the U.S. District Court for the District of New Mexico, including against a counterclaim for wrongful termination.
- Representing a leading federal construction contractor on Contract Disputes Act claims against the General Services Administration before the Civilian Board of Contract Appeals.
- Representing a marine contractor in wrongful termination action and differing site conditions claim before the Armed Services Board of Contract Appeals.
- Representing a marine contractor at the U.S. Court of Federal Claims on claims related to government-caused changes and delays on a pier construction project.
- Successfully intervened in and defeated a Government Accountability Office (GAO) bid protest challenging the presumptive awardee, Burns & McDonnell Engineering Co. Inc.’s award of a $20 million Indefinite Duration/Indefinite Quantity (IDIQ) Multiple Award Task Order Contract (MATOC) for Architect/Engineering services for the U.S. Naval Facilities Engineering Systems Command Pacific (NAVFAC Pacific).
- Securing dismissal of a Federal District Court complaint based on the Southern District of New York’s first-to-file doctrine
- Preparing a legal opinion for a lithium-ion battery manufacturer concerning Buy America Act compliance
- Representation of commercial building contractors with respect to bid protests and size protests before the Government Accountability Office and Small Business Administration, respectively
- Defending an employee of a leading geotechnical construction firm in suspension and debarment hearings before the Environmental Protection Agency

Prior to joining the firm, Nick was an attorney with a large international law firm’s global litigation group. While in law school, Nick was a Chancellors Scholar at the University of North Carolina School of Law and a staff writer for the North Carolina Law Review.
