Fox Rothschild’s Financial Restructuring & Bankruptcy Department attorneys regularly represent receivers, lenders, local governments, and other stakeholders in state and federal receiverships and other asset recovery proceedings. Some of our attorneys have even served as receivers, managing real property to preserve assets and help ensure equitable outcomes for all parties.

Our experience includes:

  • Representing lenders (including administrative agents and servicers), institutional investors, equipment financiers/lessors and other secured creditors in foreclosures, credit restructurings, inter-creditor agreements, and complex asset recovery and repossession proceedings.
  • Counseling receivers in state and federal receivership matters involving real estate, mortgage-backed securities, and asset-backed securities. They also handle related Uniform Commercial Code (UCC) foreclosures on equity interests and common stock.
  • Foreclosing on various types of real property, including office buildings, hotels, shopping centers and apartment buildings. If the property involved has health and safety issues, we navigate reclamation matters.
  • Representing property and rent receivers in foreclosures and consensual private sales of shopping centers, office buildings and other commercial properties. Fox has advised receivers concerning their management, sale, and leasing of receivership property and the recovery and distribution of receivership assets.
  • Advising businesses and receivers in cases alleging fraud, fraudulent conveyances, Ponzi schemes and fidelity claims. These receivership cases often involve a scheme to defraud, resulting in a failed business and/or defrauded investors.
  • Representing receivers dealing with the cannabis industry.
