Biography

Scott is a seasoned trial lawyer whose practice focuses on complex business and health care litigation with an emphasis on high-stakes disputes involving professional liability, products liability, consumer protection, financial services and real estate. He represents businesses and high-net-worth individuals in state and federal courts and in arbitration, guiding clients from pre-suit strategy through trial and resolution.

Known for his tactical, business-minded approach to litigation, Scott regularly serves as first-chair trial counsel in matters involving significant financial and reputational exposure. His experience includes defending “bet-the-company” matters, handling of class action litigation, and prosecuting as well as defending actions involving restrictive covenants, trade secrets, breaches of fiduciary duties and partnership disputes.

He also advises clients in bankruptcy-related litigation and disputes involving upstream entity and corporate liability. In addition, Scott frequently assists other litigators with jury selection, expert witness strategy and trial examination, preparation and examinations of corporate representatives, and has served as an attorney’s fee expert.

Scott also is a Florida Supreme Court Certified Circuit Civil Mediator.

Representative Matters

  • Served as lead trial counsel in multiple “bet-the-company” jury trials involving alleged medical and professional negligence and achieved defense verdicts in which plaintiffs requested damages of $157 million, $88.5 million, $55 million, $30 million, $12 million, $10 million and others.
  • Prosecuted and secured a multimillion-dollar jury verdict for a client who suffered losses resulting from its former executive's and employees' theft of trade secrets, breaches of fiduciary duties and violations of restrictive covenants.
  • Achieved dismissal of a high-profile claim against a Fortune 500 company alleging a conspiracy with health care providers to violate the Medicare Secondary Payer Act.
  • Resolved a high-exposure putative class action matter involving alleged mislabeling and health concerns brought by consumers of an energy drink against the manufacturer, following denial of class certification, for $5 to each of the three individual plaintiffs.
  • Secured a seven-figure settlement for a specialty care pharmacy involved in a payor/payee reimbursement dispute.
  • Successfully defended a regional telecommunications company against claims seeking eight-figure compensatory and punitive damages.
  • Obtained over $25 million in judgments and collected settlements on behalf of a group of EB-5 investors who fell victim to a failed Ponzi scheme.
  • Represented a high-profile physician in a contentious partnership dispute and series of lawsuits and arbitrations against his former partner securing dissolution and an overall favorable resolution for the client.
  • Served as defense counsel in a jury trial involving allegations of medical negligence, fraud and FDA regulatory violations, defeating punitive damages claims.
  • Attained multiple defense verdicts and favorable arbitration awards in elder abuse and nursing home negligence matters.

Before Fox Rothschild

Before joining us, Scott was a partner in a national, AmLaw 100 firm. Earlier, he held associate positions at litigation-focused law firms based in South Florida. While in law school, he worked as a legal intern with the executive management of a professional sports franchise.
