A HIPAA Update and Refresher- What's New for 2021

First, this presentation will address changes to HIPAA that are expected to be implemented in 2021 in response to the Office for Civil Rights (OCR) Notice of Proposed Rulemaking issued in December 2020. Such proposed changes include: (i) strengthening individuals' rights to access their own health information; (ii) improving information sharing for care coordination and case management for individuals; (iii) facilitating greater family and caregiver involvement in the care of individuals experiencing emergencies or health crises; and, (iv) reducing administrative burdens on HIPAA covered health care providers, while continuing to protect individuals health information privacy interests. Second, by using recent settlement agreements between providers and OCR as teaching tools, the presentation will provide a refresher on specific HIPAA requirements. Some items that will be addressed include; (i) a patient's right to access information, (ii) breach identifications and reporting; and, (iii) entering into business associate agreements. Finally, it will address the impact of the Cybersecurity Safe Harbor Provision that was signed into law on January 5, 2021. It will discuss how the law impacts security best practices for providers.
