In North Carolina, marriage vests an individual with the right to claim an “elective share” upon his or her spouse’s death. To successfully petition for an elective share, a surviving spouse must initiate an estate proceeding pursuant to Article 1A of Chapter 30 of the North Carolina General Statutes. This presentation identifies and explains the multitude of statutory requirements and procedures that must be followed by a surviving spouse and the personal representative of a deceased spouse’s estate when litigating the elective share.
