The Ethics of Representing Entities and Their Employees
This program will cover two ethical issues relevant to nearly all practitioners. First, experienced litigators will identify and explore the ethical issues that can arise when a business and the people who work there face civil or criminal exposure.
Attendees will learn when it is necessary or recommended to retain separate counsel for individuals, ethical issues to have on your radar and practical tips for engagement letters, third party fee agreements and joint defense groups. In the second hour, panelists will look at the nuts and bolts of the attorney disciplinary process in Pennsylvania. With a panel of attorneys who routinely represent other attorneys facing disciplinary issues, the program will cover frequently raised issues, the process from complaint through resolution and what to do if you find yourself the subject of a disciplinary complaint.
Additionally, this program will cover issues relevant to many areas including civil litigation, criminal law, family law, labor and employment, professional ethics, corporate practice and small firm and solo practitioners. Any attorney who represents corporations or other business entities in any type of criminal or civil litigation or internal investigation should attend to learn the ethical issues that could arise when interacting with individual employees of the business, particularly when those people could face criminal or other regulatory exposure.
Additionally, all attorneys, no matter how careful, could find themselves the subject of a disciplinary complaint, even if entirely unfounded. An understanding of the disciplinary process, what to expect and where to turn for help is key to navigating any potential issues with confidence.
