Our lawyers don't dabble in the legal cannabis sector, they've represented cannabis businesses since the industry was in its earliest stages. We've seen and helped clients solve a full spectrum of problems, and leverage that experience to provide effective, efficient advice that produces results.
We help businesses in the medical and adult-use cannabis segments navigate a broad range of organized labor issues, including contract negotiations, grievance processing and Labor Peace Agreements, as well as a wide variety of everyday workplace issues such as employee background checks, worker classification and discrimination claims, sexual harassment and workplace health and safety.
Our experience includes:
- Representing Jushi in several matters that resulted in defeating unionization and leading collective bargaining negotiations for its Scranton-area facilities that resulted in a favorable CBA.
- Leading the collective bargaining negotiations for a dispensary that resulted in a favorable CBA.
- Providing labor relations counseling and advice to national union-represented cannabis employers including collective bargaining agreement administration, grievance processing and labor arbitrations, labor relations training, National Labor Relations Act compliance, design and implementation of compliant workplace policies and procedures; mid-term union negotiations and day-to-day labor relations counseling.
- Overseeing successful campaign that resulted in a union withdrawing its National Labor Relations Board petition filed against one of our clients.
- Advising client on labor/corporate issues involved in the acquisition of a cannabis company with unionized workers.
- Conducting labor due diligence in cannabis industry corporate transactions.
- Negotiating and administer Labor Peace Agreements.
- Representing cannabis employers in proceedings before the National Labor Relations Board, Equal Employment Opportunity Commission and other state and federal agencies.
- Advising clients on employment law issues related to state legalized medical marijuana.
- Researching and delivering opinion on whether employees may be fired for consuming marijuana when they are off work.
- Examining unemployment benefits for an employee fired for consuming medical cannabis.
- Outlining duty to provide reasonable accommodation for employees using medical cannabis.
- Defending multistate cannabis operators against employment discrimination cases before the EEOC and in federal courts.
