Government Contracts & Construction
Diana advises and represents government contractors and construction firms in a broad range of matters. Here are select examples of her contracting and construction law experience:
- Represented Precon Marine, Inc., and its Prime Contractor, Slone Associates, Inc. in litigation of a claim related to the repairs to a transportation Command Dock (TC Dock) at Naval Weapons Station Charleston, South Carolina. The project was plagued by numerous differing site conditions that caused Slone to experience extensive delays and incur additional costs. After a four-day trial at the U.S. Court of Federal Claims, Precon was awarded $1.25 million.
- Represented Accura Engineering and Consulting Services, Inc. to protest the National Aeronautics and Space Administration award decision for the Facilities Engineering Design and Inspection Services Contract at Marshall Space Center. The client appealed to the Court of Federal Claims, which granted its motion for judgment on the administrative record, remanded the case to the Agency for reconsideration and awarded attorneys’ fees.
- Represent Balfour Beatty Construction LLC, an international design-build contractor, in prosecuting multimillion-dollar claims against General Services Administration involving the design and construction of a subterranean Central Utilities Plant for the Department of Homeland Security’s new Headquarters Building at the historic former St. Elizabeths West Campus in Anacostia, in Washington, D.C. before the U.S. Court of Appeals for the Federal Circuit.
- Represent JE Dunn in litigating a variety of disputes arising out of the $55 million Hospital Addition and Century Utility Plant Replacement at the Joint Base Langley-Eustis, VA against its mechanical and plumbing subcontractor for ongoing defaults and delays.
- Provided legal advice related to small business utilization on federal and private contracts to W.G. Yates & Sons Construction Company, drafting subcontracting plans and participation plans, supporting small business utilization efforts and creating processes and controls to manage federal and state regulatory requirements involving $2.5 billion in federal work and $3 billion in private work.
- Advised S.J. Amoroso Construction in navigating the Small Business Administration’s Mentor-Protégé program with its protégé, forming the joint venture entity and preparing it for federal work acquisition as well as assisting with Federal Acquisition Regulation compliance.
- Represented Jacobs Project Management Co. in successfully arbitrating and resolving a multimillion-dollar construction dispute with an HVAC contractor involving alleged delays, lost productivity and unpaid contract balances arising from the renovation of buildings 302 and 336 at the Dupont Experimental Station in Wilmington, DE.
- Represent a major national civil engineering and design firm in a dispute involving a massive public transit expansion project.
- Advising an international energy and services company on all aspects of U.S. federal government construction compliance, specifically related to its utility distribution infrastructure related to a federal Indefinite Delivery, Indefinite Quantity (IDIQ) contract valued at $55 billion.
