Biography
Erika counsels clients on a wide variety of labor and employment issues, including compliance with federal and state wage and hour laws and discrimination statutes.
An experienced litigator, Erika defends employers in claims brought by individual plaintiffs and in larger class and collective actions brought under employment statutes and ERISA.
Erika also litigates commercial cases on behalf of both plaintiffs and defendants. She also serves as local counsel for the firm in patent prosecution cases brought in the District of Massachusetts.
Representative Matters
Erika has successfully defended claims brought by employees in federal court, or has forced such cases to settle for significantly less than their original demands.
Erika’s successes include:
- Secured summary judgment dismissal for an employer of discrimination and retaliation claims brought under Title VII and the Equal Pay Act, Successfully defended the trial court’s ruling in an appeal before the Third Circuit.
- Drafted a substantial portion of the winning opposition to a plaintiff-employee’s motion to authorize notice to a proposed class under the Fair Labor Standards Act. The ruling led to a settlement for far less than the original demand.
- Mediated health care fraud claims brought pursuant to ERISA.
Before Fox Rothschild
Erika has wide-ranging connections in the Pennsylvania, Massachusetts, and New Jersey legal communities. Prior to joining Fox, Erika was a law clerk for two years to Chief U.S. Magistrate Judge M. Page Kelley of the District of Massachusetts, where she drafted judicial opinions on a variety of matters, evaluated discovery motions, and supervised interns.
Before that, Erika was a litigation associate in the Philadelphia office of a regional law firm, where she gained valuable litigation experience. She also served as a law clerk to Judge Michael J. Haas of the Superior Court of New Jersey, Appellate Division, a judicial intern to U.S. Circuit Judge Dolores K. Sloviter of the Court of Appeals for the Third Circuit and a judicial extern to the U.S. District Judge Ann Marie Donio of the District of New Jersey.
While in law school, Erika was managing editor of the Rutgers University Law Review.
Beyond Fox Rothschild
Erika mentors undergraduate students considering law school through Boston College's Eagle Exchange Program. She also participates in Fox’s recruitment efforts at her alma maters, and serves as a mentor to junior and summer associates.
A former marathoner and half-marathoner, Erika has run the Boston Marathon, the Philadelphia Half-Marathon, and the Independence Blue Cross Broad Street Run in support of various charities.
She is also an active member of the Young Friends of Philly PAWs, a nonprofit, no-kill animal shelter based in Philadelphia. Erika is involved in various community activities within her hometown of Gloucester City, New Jersey.
