Clashing Rights: When Workers’ Rights Collide and Reverse Discrimination

How should employers handle situations when their employees have job-related rights that collide? The answers aren’t always clear, and employers often feel stuck between a rock and a hard place and fear facing a lawsuit no matter what they do. Our insightful program provides guidance, both from the public and private perspectives, about how employers can resolve situations where multiple employees assert rights that clash. Using hypothetical scenarios, our panel discusses how to advise employers when more than one employee claims their rights have been violated because of a workplace situation. Our program will also include thoughts from plaintiffs’ attorneys as to how to navigate these circumstances while advocating for a client, and insight from mediators into how they attempt to resolve these types of cases.
