For many employers, the pandemic forced employees into a work-from-home setting. With this change, multiple states have imposed more onerous restrictions on employers' use of restrictive covenants. The increase in noncompetition and nondisclosure may not have been caused by an increasingly remote workforce, but the new laws create additional obstacles for businesses managing remote workforces.
