Retirement plan lawsuits against employers for breach of fiduciary responsibility is at an all-time high. By focusing on plan governance, organizations can implement a prudent process for carrying out their fiduciary responsibility, improve the quality of the retirement plan they offer employees, and mitigate the risks of a lawsuit. A new retirement law will also be discussed on how to improve retirement savings. We will cover two important topics that have a direct impact for organizations and the benefits offered to their employees. We will cover the basic rules that fiduciaries of retirement plans must abide by and then discuss proper plan governance to ensure compliance. This will be followed with an example retirement committee agenda item for the plan’s fiduciaries to address the SECURE 2.0 Act of 2022, which builds on and expands the SECURE Act of 2019 to improve retirement savings opportunities.
