He drafts, reviews and negotiates many of the industry’s common agreements, including shipper/motor carrier agreements, broker/motor carrier agreements, shipper/broker agreements, independent contractor agreements, lease-purchase agreements, equipment interchange agreements and warehousing agreements. His contract work focuses on risk allocation, insurance requirements, indemnity provisions and liability limitation strategies designed to protect clients and improve operational efficiency and profitability.

Freight Claims

Marc regularly assists clients with freight and cargo claims, including claims arising under the Carmack Amendment, and handles freight claims litigation in multiple jurisdictions. He is a frequent instructor and speaker on freight claims and cargo liability issues.

Accident Claim Defense and Emergency Response

When a client’s driver is involved in an accident, Marc investigates and defends accident and injury claims ranging from catastrophic injuries and fatalities to property damage and cargo losses. He is involved in rapid response accident investigations and regularly assists clients in defending claims involving negligent hiring, supervision, retention and training of drivers.

Broker Liability and Insurance Coverage

Marc also has significant experience defending broker liability claims involving the negligent selection of motor carriers. He also handles insurance coverage disputes involving trucking and transportation policies, including issues relating to the MCS-90 endorsement and related filings.

Logistics and Supply Chain

Marc advises logistics companies, brokers and third-party logistics providers on complex logistics and supply chain operations across all modes of transportation. He assists clients in structuring contracts and operations to match their business models, limit liability exposure and address the evolving role of technology, e-commerce and automated systems in modern logistics operations.
