Biography

Adam advises clients across the full lifecycle of construction and development matters, from drafting and negotiating project agreements to resolving disputes through litigation, arbitration and pre-suit strategies. He is Board Certified in Construction Law by The Florida Bar.

Adam's project experience in Florida and nationwide spans high-rise residential towers, hotels, luxury homes, courthouses, airports, stadiums, roadways and treatment plants, in both the public and private sectors. He handles a wide range of matters, including:

  • Contract drafting.
  • Contract disputes.
  • Delay claims.
  • Mechanics' liens
  • Bond claims.
  • Construction defect matters.
  • Insurance recovery.
  • Risk transfer and indemnity issues.

He also serves as outside general counsel to developers, associations, multinational general contractors and local builders, advising on day-to-day operations, compliance and project consultation. Having previously served as general counsel and vice president of operations for a South Florida residential roofing contractor, Adam brings a practical, business-minded perspective to every engagement.

Before Fox Rothschild

Before joining us, Adam was a Partner in the Fort Lauderdale office of a national law firm, where he led the construction practice in Florida. Before that, he was a Partner and Co-Chair of the Construction Practice at a Florida law firm and practiced at firms throughout South Florida. He also served as General Counsel and Vice President of Operations for Florida's largest residential roofing company.

Representative Matters

  • Obtained summary judgment on behalf of a national general contractor in highly technical litigation against a supplier.
  • Successfully mediated unlicensed contracting claims on behalf of homeowners in Boca Raton resulting in payment for full damages sought, plus legal fees.
  • Secured favorable early resolution in arbitration on behalf of a project owner against a design-builder involving competing multimillion-dollar claims over a local stadium project.
  • Compelled pre-suit mediation in two related payment bond lawsuits and successfully resolved claims for a national general contractor against a primary subcontractor and its lower tiers.
  • Obtained favorable resolution of a $28 million construction defect claim on behalf of a subcontractor.
  • Drafted and negotiated construction and design agreements, including insurance and bonding programs, for a $130 million student housing project.
  • Obtained a complete defense arbitration award on behalf of a local builder.
  • Successfully resolved a catastrophic injury lawsuit on behalf of a condominium association involving renovations to the property.
  • Led development deals totaling in excess of nine figures in aggregate project value.
