This CLE Breakout Session will address and review: (i) the legal status & obligations of guardians as fiduciaries; (ii) real-life case studies of discovered guardianship abuses; (iii) applicable best practices for how such abuses could have been avoided; (iv) proposed & pending changes to Pennsylvania's guardianship legislation; (v) best practices under to identify and address the potential for abuse and exploitation in guardianships; and (vi) the current, and future plans for, available resources to assist the judiciary, practitioners, and guardians in guardianship oversight, compliance, and enforcement.
