This year, New York became the first state in the U.S. to require employers to provide employees with paid time off for prenatal care. With this backdrop in mind, this presentation will untangle the various city, state, and federal employment laws related to pregnancy in the workplace, including pregnancy and lactation accommodation requirements under the ADA, the Pregnant Workers Fairness Act, and the New York State and City Human Rights Laws, as well as leave requirements under the FMLA, the New York State Paid Family Leave Law, the New York State Prenatal Leave Law, the New York State Paid Sick Leave Law, and the New York City Earned Safe and Sick Time Act. We will discuss how employers can best navigate these laws and ensure their companies’ policies and procedures are in compliance. Finally, we will discuss the current legal landscape of litigation involving pregnancy discrimination in the workplace.
