Elusive Lucidities: Eyford v. Nord and California's Delusion Doctrine

When does an irrational belief invalidate an otherwise valid estate plan? This MCLE webinar with guest speaker Evan Winet, examines the evolution and modern uncertainty of California’s insane delusion doctrine, through the lens of the appellate analysis in Eyford v. Nord.
Drawing on statutory authority in the California Probate Code and the doctrine’s historical roots, the presentation will examine the tension between psychiatric understandings of delusion and the courts’ preference for testamentary autonomy. Through a close reading of Eyford and earlier authorities, the presentation will explore the evidentiary burdens, causation challenges, and strategic pitfalls confronting both contestants and proponents.
