Fox Attorney Andrew Stoll Prevails in Trial on Challenge to Transfer of Real Estate

In a protracted court battle over a transfer of properties located in Philadelphia, Fox Rothschild attorney Andrew Stoll secured a victory for his clients.  In finding in favor of Stoll’s clients, the court resoundingly rejected claims by two adversaries who challenged the transfer on factual and legal grounds. 

In a non-jury trial, Stoll proved that the transferor was of sound mind and that the deeds were prepared and recorded in compliance with Pennsylvania law, and that the adversaries’ technical arguments to the contrary were unsupported by fact or law.

In an 18-page decision, the Honorable James C. Crumlish, III of the Philadelphia Court of Common Pleas found that Stoll presented “overwhelming” evidence to show that his adversaries’ factual arguments were meritless, and that the legal arguments contesting the transfer were unsupported.

The case was initially presented for a hearing before the Orphans’ Court of Philadelphia on a related will contest for the properties.  In the second round of litigation before Judge Crumlish, it was argued that Stoll’s client exerted “undue influence” to effectuate the transfer, and that the transfer was void to due to certain technical defects with the drafting and recording of the deeds.

But Stoll, assisted by Fox partner Adam Silverstein, proved at the two-day trial that their adversaries’ claims had no legal basis and the transfer met all of the requirements to transfer real estate under Pennsylvania law.
